Annual Report about condition of distribution of public information at the Chancellery of the Government of Georgia according to requests of article 49 of General Administrative Code of Georgia(From January 1, 2012 to December 10, 2012)



The Chancellery of the Government of Georgia conducted its activities during the report period within requests of norms of General Administrative Code of Georgia.

Requests about issuance of public information generally referred to orders of Georgian Prime Minister, resolutions and decrees of government of Georgia, minutes of meeting of government of Georgia, official correspondence, responses accepted in relation to reviewing of applications of citizens.

95 written applications for issuance of public information were registered during the report period of the year 2012. 44 requests were satisfied, 32 applications were sent to relevant authorized administrative bodies according to articles 40 and 80 of above mentioned code. Decision regarding refusal of requesting of public information was made in 13 cases as part of them didn't represent public information kept at the Chancellery of the Government of Georgia (6 applications are being processed).

Decision on denial to satisfy request of public information was made by authority of the Chancellery of the Government of Georgia considering the position of legal department/service.

Resolution regarding issuance of public information was appealed by non-governmental, non-commercial legal entity Institute for Development of Freedom of Information. Georgian government issued requested legal acts after which the author of complaint refused administrative complaint according to article 191 of General Administrative Code of Georgia. Administrative complaint was also submitted by association "Green Alternative". Requested public information was issued by the Chancellery of the Government of Georgia in relation to above mentioned complaint according to existing legislation. Besides, proceedings are under way at Administrative Cases Panel of Tbilisi City Court in respect with claim of Georgian Young Lawyers Association in relation to request of ordering of issuance of public information. Expenses of appealing, including payment of money in favor of the party wasn't imposed on the Chancellery of the Government of Georgia.

All applications about requesting of public information which were denied were satisfied after November 1, 2012. 10 applications submitted to the Chancellery of the Government of Georgia after November 1, 2012 were satisfied.

There were no cases of violation of requests of administrative code by responsible officials of the Chancellery of the Government of Georgia and also there were no cases of imposing of disciplinary fines on them.

Meetings of the government of Georgia were held according to rules determined by regulations of the government of Georgia within the report period. In some cases several issues were discussed publicly, with participation of representatives of press and TV and stakeholders. Briefings and Press-conferences were held in relation to different issues.
