Annual Report (from January 1 to December 10 of 2010) on the status of giving public information in the Government Chancellery of Georgia, according to requirements of the Article 49 of the General Administrative Code of Georgia


During the calculation period, the Government Chancellery of Georgia carried out its activities within the requirements of the General Administrative Code of Georgia observing the principles of freedom and transparency of public information.

Requirements for giving public information concerned mainly the orders of the Prime Minister of Georgia, resolutions and decrees of the Government of Georgia, minutes of meetings of the Government of Georgia, official correspondence, responses with respect to discussion of citizens' statements and copies of resolutions. While giving public information, the terms of providing such information established by the Article 40 of the General Administrative Code were observed.

During the calculation period of the year 2010, in total, 83 written applications on giving public information were registered, out of which 39 applications were satisfied, 34 applications were forwarded to the respective authorized administrative body, according to the Articles 40 and 80 of the aforementioned Code, while in 10 cases, claims for receipt of public information were declined, as they did not represent the public information kept in the Government Chancellery of Georgia.

Decision on declining claims for public information was made by the authorities of the Government of Georgia, on the basis of memorandum of the Legal Department of Georgia.
When discussing or declining the applications on public information, the Government Chancellery of Georgia was guided by the General Administrative Code, Regulations of the Government Chancellery of Georgia and other respective legislative acts.
The Head of the Government Chancellery of Georgia has issued the Order No 215 of April 16 of 2010 and the Order No 227 of May 21 of 2010 on administrative suits against declining claims for public information. The Government Chancellery of Georgia has not been imposed any liability to cover expenses related to the appeal, including payment of any other sums in favor of the party.
There have been no cases of violation of requirements of the General Administrative Code of Georgia by the Authorized Officials of the Government Chancellery of Georgia and no disciplinary fine has been imposed on them.
During the calculation period, the government meetings were held at the Government Chancellery of Georgia within the time limit of the Government of Georgia. In separate cases, according to the decision of the Government of Georgia, discussion of a number of issues was carried out publicly, with participation of the press and TV representatives and interested persons. Briefings and press conferences were held with respect to various issues.
